Terms of Service
These terms are an agreement between you and Trout Creek LLC, a New York limited liability company doing business as Zoom Out Game ("Zoom Out Game," "we," "us"). They cover zoomoutgame.com and everything on it (the "Game"). By playing, signing in or buying anything, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Game.
1. Who can play
You must be at least 13 years old to use the Game. If you're under 18, a parent or guardian must agree to these terms for you and must make or approve any purchase.
2. The Game
The daily is free with no account. Practice is free with a free account. Challenges and other Pro modes need Zoom Out Pro, after a 3-day free trial. We may add, change or remove modes, packs, photos and features at any time. We'll try to give notice before taking away something that Pro members pay for.
3. Accounts
You don't need an account to play the daily or to browse the challenge library. Practice and Pro modes need a free account. Your results are tied to a random player ID saved in a cookie on your device. You do need to sign in (with Google, or with an emailed link where we offer it) to buy Pro, and your purchases belong to that account. Keep access to your email or Google account secure. You're responsible for what happens under your account. We may suspend or close accounts that break these terms.
4. Zoom Out Game Pro: payments and automatic renewal
- Price. Pro costs $5.99 per month or $47.99 per year in US dollars, plus any tax that applies. The price is shown before you pay.
- Automatic renewal. Your subscription renews automatically at the end of each month or year, and the card on file is charged the then-current price, until you cancel.
- Cancelling. You can cancel any time from Manage subscription in your profile, or by emailing us. When you cancel, you keep Pro until the end of the period you've already paid for, and you won't be charged again.
- Switching plans. You can switch between monthly and yearly from Manage subscription. Any charge or credit for the switch is shown before you confirm.
- Price changes. If we change the Pro price, we'll email you at least 30 days before it applies to your next renewal, so you have time to cancel.
- Free trial. When you first sign in, you get 3 days of Pro free, with no payment method needed. When the trial ends, Pro features stop unless you subscribe. One trial per person.
- Failed payments. If a renewal payment fails, Pro may be paused or ended until the payment goes through.
- Payment processing. Payments are handled by Stripe. We never see or store your full card number. Stripe's own terms and privacy policy also apply to your payment.
- Promotion codes. Discounts and promotion codes apply only as stated when you use them. They have no cash value, and we may end them at any time.
5. Refunds
Payments are generally non-refundable, and we don't give partial refunds for unused time after you cancel. But we want to be fair. If you were charged by mistake, forgot to cancel a renewal, or Pro didn't work for you, email support@zoomoutgame.com within 14 days of the charge, and we'll review it in good faith. Nothing in this section limits any refund rights you have under the law where you live.
6. Fair play and acceptable use
When you use the Game, you agree not to:
- cheat, use bots or scripts, or tamper with scores, streaks or crowd stats;
- scrape, copy or redistribute the photos, puzzles or answers in bulk;
- interfere with the Game's servers or security, or try to get into accounts that aren't yours;
- use names or text (for example, in party games or feedback) that are hateful, harassing, sexual or illegal, or that pretend to be someone else;
- use the Game in any way that breaks the law.
Scores are checked on our servers. We may remove results that break these rules from rankings and crowd stats, and we may suspend accounts for serious or repeated abuse.
7. Photos, credits and our content
Many photos in the Game are used under Creative Commons licenses (CC0, CC BY or CC BY-SA). Each photo's photographer, license and source are shown when the photo is revealed and listed under Credits. Those photos stay under their own licenses. Everything else, including the Game's design, code, puzzles, text and the Zoom Out Game name and logo, belongs to us or our licensors. You may use it only to play the Game for your own personal, non-commercial use. Sharing your results with the Game's share feature is welcome.
Copyright concerns. If you believe a photo or anything else in the Game infringes your rights, email support@zoomoutgame.com. Tell us what the work is, where it appears in the Game, and how to reach you. We'll review it and remove it if appropriate.
8. What you send us
If you send feedback, ideas or suggestions, we may use them without owing you anything. Names or text you enter in the Game must follow section 6. You give us permission to display them as part of the Game.
9. Disclaimers
The Game is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Game will always be available, error-free or that every answer or fun fact is accurate.
10. Limit of liability
To the fullest extent the law allows, Zoom Out Game and Trout Creek LLC aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim related to the Game is limited to the greater of (a) what you paid us in the 12 months before the claim or (b) $50. Some places don't allow these limits, so they may not fully apply to you.
11. Ending your use
You can stop using the Game at any time. To delete your account and results, email us. We may suspend or end your access if you break these terms. If we end the Game entirely, we'll refund any unused, prepaid Pro time. Sections 7 through 13 survive after your use ends.
12. Changes to these terms
We may update these terms from time to time. If a change is important, we'll show a notice in the Game or email signed-in players before it takes effect. Continuing to use the Game after a change means you accept the new terms.
13. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Before filing any claim, please email us first so we can try to resolve it informally. Any dispute that isn't resolved that way will be heard only in the state or federal courts located in New York, and both sides agree to those courts' jurisdiction. Either side may still bring an eligible claim in small claims court.
14. Everything else
These terms and the Privacy Policy are the whole agreement between you and us about the Game. If any part is found unenforceable, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. You may not transfer these terms to anyone else. We may transfer them as part of a sale or reorganization of the business.
